Upcoming Changes to the Fair Labor Standards Act (FLSA)
and the Impact on VCU
Human Resources is currently reviewing the potential impact of the U.S. Department of Labor (DOL) proposal that would extend overtime protection to employees. DOL’s proposal would more than double the minimum salary requirement for those eligible for overtime from $23,660 ($455/week) to $50,440 ($970/week). The department also has proposed automatic annual increases to the minimum salary threshold based on a graduated schedule. Compliance with this new rule may be required as early as May 2016. For universities, teaching faculty will remain exempt from the salary requirements of the law.

Human Resources is developing an action plan to address this issue for the entire University. We will keep you informed about next steps as they develop and provide you with a list of questions and answers that may help you anticipate changes for your department.

Invitation to Self-Identify (Use New Post-Offer Self-Identification Form)
As a government contractor, VCU takes affirmative action to employ and promote qualified women, minorities, individuals with disabilities and protected veterans. VCU’s Post-Offer Self-Identification Form allows new employees to self-identify their race, sex, veteran status, and disability status. While completion of the form is voluntary, providing the form to new hires before their first day of work is required by the federal government. To comply with these laws, this form needs to be mailed to new hires (classified and faculty) before their first day of work. The form is in addition to and should be included with other new hire paperwork. The form includes three pages and is available here: http://hr.vcu.edu/media/hr/documents/PostOfferSelfIdentificationForm.pdf. Once the form has been completed by the employee, it should be submitted to HR Operations along with other new hire paperwork.

UPDATED Personal Data Form
As of January 4, 2016, the Personal Data Form has been revised to exclude the post-offer self-identification questions which now are in the separate form noted above. This form can be found here: http://hr.vcu.edu/media/hr/documents/Personal_Data_Form.pdf and should still be completed along with other new hire paperwork.
